Section 15
Tariffs are subject to review
(1) A service provider who is not satisfied with the tariff determined by the commission in accordance with section 13 may submit an application to the Ministry of Physical Planning and Construction within thirty days from the date of receiving the notification of the tariff determination along with a reasonable and sufficient reason for the dissatisfaction.
(2) If an application is received in accordance with sub-section (1), the Government of Nepal may constitute a Tariff Review Commission with the following chairman and members:-
(a) A person who has become or is qualified to become a judge of a High Court – President
(b) A person with at least a master's degree in engineering and at least fifteen years of experience in the field of water supply or sanitation - member
(c) A person with at least a master's degree in Chartered Accountancy or Commerce with at least fifteen years of experience in auditing - Member
(3) The Tariff Review Commission shall conduct a necessary investigation on the application received in accordance with sub-section (1) and review the tariff set in accordance with section 13.
(4) The Tariff Revision Commission may also hold a public hearing as prescribed before revising the tariff in accordance with sub-section (3).
(5) Tariff Review Commission shall study the suggestions received during the public hearing as per sub-section (4) and review the tariff within thirty days from the date of commencement of work and publish a public notice thereof.
(6) The fee published in accordance with sub-section (5) shall be final.
(7) The Secretariat of the Tariff Review Commission will be in the Ministry of Physical Planning and Construction.
(8) The officer designated by the Ministry of Physical Planning and Construction will work as the Secretary of the Tariff Review Commission (9) The Ministry of Physical Planning and Construction will provide the necessary personnel for the Tariff Review Commission.
(10) The meeting of the Tariff Review Commission, the arrangements related to decisions and the remuneration and facilities of the chairman and members of the said commission shall be as prescribed.
(11) The Tariff Revision Commission shall automatically be deemed to be dissolved after the completion of the work of revising the tariff in accordance with sub-section (5).
